Over the next twelve months, phase two of New Zealand’s anti-money laundering regime will be progressively rolled out to lawyers , accountants, and real estate agents.   The law creates strict obligations on these professions to gather information about their clients and to report suspicious activities.  Lawyers will be the first to feel the heat; their duties commence on 1 July 2018.  Accountants follow shortly after, on 1 October 2018.  Real estate agents join the party on 1 January 2019.  

The penalties for non-compliance can be severe.  Pecuniary penalties in excess of $5m have already been imposed on one business which failed to take heed of its obligations.  For lawyers, accountants and real estate agents the law represents a significant new and potentially catastrophic exposure.  

In this seminar, Matt and Virginia consider the purpose and objectives of the act.  They provide a high-level overview of the obligations imposed on the professions.  Finally, they summarise the enforcement options available to the regulator and discuss the exposures which may arise.
