Terms and Conditions of Enrolment

Definitions

The following terms used have the following meanings:

“We”, “us”, “our” or “PIQ” means Professional IQ College Limited

“You” and “your” means the person enrolled with PIQ

By enrolling with PIQ you agree to the following terms and conditions:

Declaration

You agree and declare that you have read our ‘Enrolling with us’ guide and these terms and conditions that you understand them and agree to abide by all terms and conditions of enrolment, study and conduct.

You further agree and declare that the information supplied your online account profile is true and correct. If any information is found to be false or inaccurate you agree that your enrolment may be cancelled and that you will be held to the terms and conditions as set out in the Withdrawals and Refunds policy as if such cancellation was a withdrawal.

Plagiarism

We expect you to complete all assignments and activities by yourself. All work must be your own and you will not present the work of others as your own (plagiarism). You cannot copy directly from any other source, including the study guides, other textbooks, the internet, or any other student’s responses. You cannot use artificial intelligence (AI), large language models, or other machine learning solutions such as ChatGPT to generate your assessment answers.  The assessment requires that you use your own words to explain or describe answers. We have employed a system that will detect plagiarism. If you are found to have plagiarised or copied your answers, you may be removed from the programme and no refund for fees paid will be issued.

Course Evaluation and Feedback

We continuously try to improve its programmes and courses. We request that all students complete a Course Evaluation and Satisfaction form.  It gives us valuable feedback on the quality of our courses and where we can improve.

Verification

You may be required to find someone in your workplace, such as a manager or supervisor, who is familiar with your work to verify and sign a declaration that you have carried out the assessment tasks correctly and that you have applied your learning to your day to day work as a requirement of the qualification. The verifier could be:

  • a current or previous supervisor, manager, mentor or professional colleague

  • a member of a professional body.

The verifier must not be:

  • a member of your family unless they are also part of your family business

  • an employee unless they hold the Level 5 qualification or equivalent.

Contact Details

We collect your personal details to identify you as a student and to ensure that records of learning are updated correctly on completion of unit standards and qualifications. You must

advise us in writing if you prefer to be addressed by a name that is different from your formal name.

supply us with a home address - not a PO Box number

provide us with your workplace details if you are working.

advise us of any changes to your personal details. 

International Students are also required to supply us with next of kin / emergency contact name, address, contact telephone number, and relationship to you.

If under 18 years old at the time of application, you will also be required to provide the name and contact details of your parent or legal guardian.

Employer disclosure

If your employer or another company or person has paid for or arranged your enrolment we will consider them to be a sponsor. They may be informed of student progress updates on a continual basis by a member of the Professional IQ College staff. The sponsor will be entitled to information such as:

  • Completion of Unit Standards

  • Completion of Assessments

  • Completion of Course/Set

  • Examination Results

  • Failure to complete the Unit Standards and assessment within the recommended/ mandatory time frame.

Privacy Act 2020

We are governed by the Privacy Act 2020 on the way we collect, use and discloses your personal information. Please refer to our Privacy Policy.

Intellectual Property

All learning and assessment materials are subject to the copyright and intellectual property rights of Professional IQ College Limited, unless otherwise stated. These materials may not be reproduced, distributed or modified without our express written permission. You are given a non-transferrable personal license to access the study material and other resources while you are enrolled. This permission is automatically revoked if you withdraw or are expelled from PIQ.

Limitation of Liability

Other than liability that we can’t exclude or limit by law, our total aggregate liability to you in any circumstance is limited to the total amount you paid us for your course in the 12 months immediately preceding the date on which the claim giving rise to the liability arose or $2,000, whichever is the lesser.

We will not be held responsible for any errors or omissions contained on any of its publications, study materials and other resources.

All implied conditions or warranties are excluded in so far as is permitted by law, including (without limitation) warranties of merchantability, fitness for purpose, title and non-infringement.

We have no liability whatsoever arising from our services in respect of any loss of revenue, loss of goodwill, loss of profit, loss of savings, loss of capital, damage to reputation or loss in connection with any other contract, or indirect, consequential, incidental, punitive, exemplary or special loss, damage or expense.

English Language Requirements

You warrant that you meet the English Language requirements which are set out in our website.

Payment

We reserve the right to withhold enrolment, the reporting of credits, and the issuing of qualifications until you have paid, in full, the course fees, including any extension fees or other charges levied by us. Further Evidence Required (FER)

Each student has three opportunities to submit responses for each assessment.  If the first assessment is not sufficient to pass, further evidence will be required (FER1).  If the FER1 is not sufficient, you will have one further opportunity to submit a FER (FER2).  Additional charges will apply for the assessment of FER2 and will be advised to you when FER 2 is requested.  These will be a minimum of $95 plus GST per assessment and will be payable prior to FER2 being assessed.

Course Duration

All our programmes are made up of a number of courses. You will be required to complete a course of study within a set period of time. This is indicated in the course materials or as advised from time to time. If you require an extension, you must request this by emailing info@professionaliq.co.nz within 3 weeks of your course expiring. Fees for extensions will apply and are advised at the time of application.

Fee Protection for Students

The New Zealand Government requires all private training establishments who are registered with NZQA to have some form of protection for student fees received in advance. Students paying their own fees (in part or full) will be required to deposit their payment directly into the Public Trust Student Fee Protect account.

Withdrawals and Refunds

Applications to withdraw must be received in writing. The minimum requirements are set out in section 236A of the Education Act 1989. We count the date we receive your application to withdraw as the date of withdrawal. You need to notify us by email (info@professionaliq.co.nz) if you wish to withdraw from a course or programme and include a detailed reason with your request. You will be eligible for a refund of fees as set out in the table below, provided we have received your written application to withdraw within the specified timeframe and:

  • you have not accessed the course online;

  • you have returned all study material provided;

  • we have not received any work for assessment;

  • your course has not been transferred; and

  • you haven’t attended any classes (where applicable)

Refund

Within 8 calendar days of enrolling

Course fees paid less the greater of

- 25% of the course fees; or

- $150 plus GST

8 days or more after enrolling

No refund

We reserve the right to charge an admin fee of $150 plus GST if you withdraw from a course prior to payment.

All refunds will be made to the person or entity that paid the fees initially.

Complaints and Concerns

If you have any concerns or complaints, you can direct them to the Academic Manager via info@professionaliq.co.nz. Assignment

You may not assign or transfer any rights, benefits or obligations under these terms to any other person without our prior written consent. We may, at any time, assign or transfer any of our rights, benefits or obligations under these terms without needing to obtain your consent to any such assignment or transfer.

Amendments

We reserve the right to amend these terms and conditions and are under no obligation to notify you personally of these changes.

Force Majeure

Neither party is liable to the other for any failure to perform its obligations under these Terms to the extent caused by Force Majeure

Governing Law

These terms are governed by the laws of New Zealand and each party submits to the exclusive jurisdiction of the New Zealand courts

Website Terms and Conditions

This site and its content are made available for the purposes of booking workshops and purchasing online education in various forms, and providing an online portal for Professional IQ college students.

It includes terms and conditions related to enrolment of NZQA Qualifications, here as well as online shopping terms and conditions below.

Email Policy

We only email you if you want us to. We do not send unsolicited emails. When you register your email address with us you go on a list to receive email announcements about products, offers and promotions and news from Professional IQ. We may disclose your email address to third parties in circumstances - check our privacy policy for further details.

Every email message we send includes an email address to which you can respond. If at any time you decide you do not want to receive our emails simply click the unsubscribe link at the bottom of the newsletter. This will remove your email address from our mailing list. If you unsubscribe you will still receive emails specifically related to your online orders.

Delivery Policy

Delivery charges are calculated and added to your order after you enter your delivery location and before you enter your payment details. You get to see the full charge before completing your purchase.

We support delivery of all of our physical products anywhere in New Zealand; however some isolated regions may require additional delivery time. If this is the case for your area we will notify you of this. We do not deliver physical items outside New Zealand, however overseas orders may still be placed with a New Zealand delivery address.

The anticipated delivery time will be within 2-4 working days unless an item ordered is out of stock in which case you will be notified of the expected additional delay.

Deliveries are made by courier. The delivery company used is dependent on your delivery location and the size of the items ordered. Our delivery charges are as follows:

  • North Island: $10.00

  • South Island: $15.00

Note that higher charges will apply for large/heavy items and also for deliveries to some rural and remote areas. We will advise you by email when you place your order if a higher delivery charge is required. We will not send the goods without your approval of this higher rate.

Description of Products

Each product purchased is sold subject to its product description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information, including product descriptions, appearing on this website at a particular time may not always reflect the position at the exact moment you place an order. For the purchase of qualifications and workshops further information can be found under our enrolment terms and conditions.

Webinars

Where online webinars are offered booking the webinar and attendance requires the use of online webinar software. If you wish to attend a webinar you are responsible ensuring that you have downloaded, tested, and can use any software advised in the invitation.

We do not accept any liability for failure or loss caused by your inability to access the nominated system.

Webinars are attended by multiple customers and by purchasing a webinar you accept that others may hear what you are saying via microphone, and acknowledge that your input into the webinar may be recorded for future use.  

If we fail to deliver a webinar, we will refund your purchase. If the failure is as a result of your IT issue, we will at our discretion provide no refund, provide a recorded version of the webinar, or provide a credit. No refund will be given if you choose not to attend the event following registration.

Returns & Damaged Goods Policy

We stand by the quality of our product and we make things right if you are not satisfied with your purchase. You can return any damaged product you buy from us for a full refund or exchange within 14 days of purchase. If physical goods have been damaged in transit please call us on (09) 3061731. No refunds will be given for undamaged products including but not limited to course material, workshop content or online education.

Pricing Policy

All prices are stated in New Zealand dollars and unless otherwise stated exclude GST.
